How much does trademark registration cost?
The costs consist of the administrative fee charged by the office and the fee for legal services. The administrative fee for a national application covering 3 classes of goods or services is CZK 5,000, with each additional class of goods and services costing an extra CZK 500. The administrative fee for an EU trademark covering one class of goods or services is EUR 850, the second class is an extra EUR 50, and the third and each subsequent class is an extra EUR 150 per class.
Can I register a trademark myself without a lawyer?
Yes, you can file the application on your own. The risk, however, is that poorly chosen classes, a conflict with an existing trademark or vague wording of the application can lead to rejection, loss of the fee and further legal complications. A preliminary search and the correct setting of classes are most often what determines success.
How long is a trademark valid and does it have to be renewed?
The registration is valid for 10 years from the filing of the application and can be renewed indefinitely for further periods of 10 years by paying a renewal fee. Keeping track of renewal deadlines is part of our trademark monitoring service.
How long does trademark registration take in the Czech Republic?
Registering a national trademark with the Industrial Property Office takes roughly 4 to 6 months, provided no one files an opposition to the application. Once the trademark application is published, a three-month period for observations and oppositions begins, and only after that does the office register the trademark.
How do I find out whether a name or logo is already taken?
We carry out a search in the trademark registers (national, European and international) and assess the risk of conflict with similar earlier marks. A match in the register alone is not enough - similarity and likelihood of confusion are also assessed, which is an expert legal evaluation.
What is the difference between a national, a European and an international trademark?
A national trademark protects you only within the territory of the Czech Republic. An EU trademark (with the EUIPO) covers all Member States of the Union (including the Czech Republic) with a single registration. International registration through the WIPO system makes it possible to extend protection to selected countries outside the EU. The choice depends on where you actually do business or plan to expand.
What is a registered design and how does it differ from a trademark?
A trademark protects the sign (name, logo) by which you distinguish your goods or services (product). An industrial design (design) protects the appearance of a product - its shape, lines, colours and ornamentation. For comprehensive protection of a product, the two forms of protection can be combined.
